3D Trademarks12 March 2009
In its first issue for 2009 the WIPO Magazine contains an article by the French trademark attorneys Franck Soutoul and Jean-Philippe Bresson which compares the practice for registration of 3D trademarks at the national level in France with that of the Community Trademark.
According to this article a three-dimensional mark may obtain protection more easily at national level than as a Community Trademark because of the more strict approach of the Office for Harmonization in the Internal Market to the regulations.
To sum up we may say that the different interpretation given by the authorities on national level and those of the European Union will dictate the future strategies of the business concerning how it will protect a trademark for a certain territory - at national level or as a Community Trademark.
